Aspire Rewards - Terms and Conditions
1.
Definition
1.1
"Hotel" means Hotel in Chinese Mainland which the card is associated as detailed on reverse of the card.
1.2
"Program" means Aspire Rewards Program.
1.3
"Membership Card" refers to Aspire Rewards Membership Card and shall include the Sapphire, Gold and Platinum Card which is issued to a Member under this Program.
1.4
"Member" means the person to whom an Aspire Rewards Membership Card or SVC Card is issued by the Hotel subject to these Terms and Conditions. A Gift Card holder or a Bonus Value Card holder is not considered as a Member.
1.5
"Account" means the account of the member with the Hotel opened in respect of the Card.
1.6
"Reward" means privilege/benefit as featured in the Program collateral and Aspire Rewards website.
1.7
"Voucher" means any vouchers gifted by the Hotel for exchange of gifts, services or products.
1.8
"Loyalty Office" shall refer to the office at the Hotel administering Aspire Rewards Program.
1.9
"SVC Card" shall refer to a registered card which has been bought with a stored value or credits loaded into the card allowing the holder to use stored credits as payment for goods and services within the Hotel.
1.10
"Stored Credits" shall mean the credits purchased from the Hotel and loaded into the card – each single credit equates to RMB 1 in value and can be exchanged for goods and services.
1.11
"Gift Card" shall mean an anonymous card with purchased credits attached to the card that may be used in exchange of goods and services within the Hotel. Gift Card holders are not considered as Aspire Rewards Members and are not entitled to any member benefits.
1.12
"Bonus Value Card" shall mean an anonymous card gifted by the Hotel to the person who purchased SVC Card. Bonus Value Card holders are not considered Aspire Rewards Members and are not entitled to any member benefits.
2.
General Conditions
2.1
The Hotel reserves the right and at any time at its absolute discretion and without giving any reason or notice, to:
a)
vary, modify or amend these Terms and Conditions in a manner deemed appropriate by the Hotel. The Member shall be bound by such amendments and not be entitled to payment of any compensation whatsoever.
b)
terminate the Program, withdraw, cancel or invalidate any Reward without liability and the Member shall be bound by such termination and not be entitled to payment of any compensation whatsoever.
2.2
The Hotel shall not be liable or responsible for any loss, damage or injury suffered or incurred by the Member in relation to or in connection with the Program and/or the goods, services, privileges, rights and merchandise provided by the Merchants. Member hereby acknowledges he/she will bear any and all risks in relation to or in connection with the Program and/or the goods, services, privileges, rights and merchandise provided by the merchants and waive any claim against the Hotel for any indemnification in case of any loss or injury.
2.3
The Member hereby authorizes the Hotel to disclose information about the Member and the Account to third parties only for the purposes of the Program or as required by the authorities.
2.4
The Hotel's decision on all matters pertaining to the Program shall be final and binding on the Member and no correspondence shall be entertained.
2.5
The Hotel records of all matters relating to the Program shall be conclusive and binding on the Member.
2.6
The Hotel shall not be held liable for any delay in service arising from undelivered correspondences due to the fault of third party dispatch services and change of or incorrect address which has not been communicated to Aspire Rewards Program.
2.7
The Hotel shall not be liable if it is unable to perform its obligations under these Terms and Conditions, due directly or indirectly, to the failure of any machine or communication system, industrial dispute, war, Act of God or anything outside the control of the Hotel.
2.8
The Hotel reserves the right of final explanation for these Terms and Conditions.
2.9
In the event of any inconsistency between these Terms and Conditions and any promotional material relating to the Program and/or the Rewards, these Terms and Conditions shall prevail.
2.10
Any oral words of staff of the Hotel shall not constitute commitments of the Hotel and shall not be binding on the Hotel.
2.11
The Hotel shall not be liable or responsible for any loss, damage or injury suffered or incurred by cardholders in relation to or in connection with the products and services provided by the participating outlets not managed by the Hotel. Cardholders hereby acknowledge he/she will bear any and all risks in relation to or in connection with the products and services provided by the participating outlets not managed by the Hotel and waive any claim against the Hotel for any indemnification in case of any loss or injury.
3.
Eligibility / Participation
3.1
Chinese Citizens, Permanent Residents who are not residing at the Hotel either temporarily or on a permanent basis and who are not directors, employees and relatives of the employees of the Hotel are eligible to apply for and participate in this Program, subject to the Terms and Conditions herein contained.
3.2
The Membership Card issued to the Member is not transferable. The Hotel reserves the right to refuse privileges (discount, etc) should the card be used by a person other than the Member.
3.3
The Membership Card shall at all times remain the property of the Hotel and must be surrendered to the Hotel upon request.
3.4
Notwithstanding anything herein, the Hotel reserves the right to refuse any applicant, customer or Member from participating in the Program with or without assigning any reasons whatsoever.
3.5
The Program is valid only in the Hotel that is shown on the reverse of the card unless otherwise stated.
3.6
Participation in the Program requires the member to maintain a Member's Account with the Hotel.
3.7
Any eligible person (refer to clause 3.1) who patronizes in any of the participating outlets of the Hotel, could participate in the Program by submitting the completed application form to the Hotel.
3.8
The Hotel may at its sole discretion, issue an Account to Members who have previously held an Account with the Hotel under a similar Program. The Hotel shall have the right to cancel any such Card issued by it due to an apparent error and without any compensation to the Member.
4.
Qualifying Goods and/or Services
4.1
Specific products and services at the participating food and beverage outlets of the Hotel (excluding room charges, room service, mini bar, business centre services, transportation, laundry, banquet and catering), are hereto referred to as the Qualifying Goods and/or Services.
4.2
The Hotel reserves the right to increase or decrease the number of participating outlets as it deems fit.
4.3
The Hotel shall have absolute right to close any part of the Hotel for the purpose of renovation and/or redesigning and/or for any other reasons, temporarily or permanently.
5.
Privileges
5.1
The Hotel reserves the right to modify privileges at any time without assigning any reasons whatsoever.
6.
Transferability
6.1
Discounts and other privileges awarded cannot be transferred, assigned or otherwise dealt with.
7.
Discounts where applicable
7.1
Discount is deducted off the total bill in accordance with the promotions applicable terms and conditions.
7.2
No discount shall be applicable for purchases made when Membership has not been approved by the Hotel.
8.
Membership
8.1
Upon approval of the membership application by the Hotel, the Member shall be awarded Sapphire Membership.
8.2
The Hotel shall award Gold Membership to Members who have accumulatively spent RMB 20,000 or more (after discount and before taxes) in purchasing Qualifying Goods and/or Services from enrolment into the Program.
8.3
The Hotel shall award Platinum Membership to Members who have accumulatively spent RMB 50,000 or more (after discount and before taxes) in Qualifying Goods and/or Services from enrolment into the Program.
9.
Voucher Usage
9.1
When using a Voucher, the Member must bring forth the relevant Voucher together with his/her Aspire Rewards Membership Card at the relevant merchant participating in the Program.
9.2
Use of the Voucher is subject to the Terms and Conditions herein stated as well as the Terms and Conditions stated on the Voucher.
9.3
The Voucher must be utilized within the period specified on the Voucher and its validity may not be extended.
9.4
Vouchers awarded and credited to any Member which is subsequently lost, misplaced, or destroyed shall be deemed forfeited and the Hotel shall not be liable to replace the Account or the forfeited Vouchers or be liable howsoever for or in respect of the said Account.
9.5
Redeemed Vouchers cannot be exchanged for Cash, Points or other Rewards.
9.6
Vouchers cannot be used to purchase any item that is on sale, special offer or used in conjunction with any other discount, membership or privilege card, offer voucher or similar scheme unless the Member is informed otherwise by the relevant participating merchant or the Hotel.
9.7
For purchases exceeding the face value indicated on the Voucher, the Member must pay any shortfall at his/her own expense.
9.8
There will be no refund of the difference by the Hotel or any participating merchant if the Voucher value is higher than the value of goods or services purchased with the Voucher.
9.9
Vouchers from Member’s Welcome package presented by the Hotel to the Member can only be used in the Hotel on the Member’s next visit.
9.10
The Hotel makes no product representation or warranty, explicit or implied, and hereby disclaims any and all liability, concerning the quality, condition, satisfactory quality, merchantability or fitness for use of the products and services provided in the Program. Cardholders hereby acknowledge he/she will bear any and all risks in use and enjoyment of any Rewards and waive any claim against the Hotel for any indemnification in case of any loss or injury. The Hotel will not be liable for any loss or injury suffered by the cardholders and / or third parties as a result of use and enjoyment of any Reward.
10.
SVC Card
10.1
Amount of each SVC Card shall be at RMB 5,000.
Individual Purchase:
Purchasers shall provide their valid identification documentation and contact details in purchasing the SVC Cards. For one time purchase of SVC Cards in the amount of RMB 50,000 or above, payment must be made via bank transfer.
Entity Purchase:
Purchasers shall provide their valid identification documentation and contact details in purchasing the SVC Cards. Payment must be made via bank transfer.
10.2
Credits stored in the SVC cards are refundable, provided the SVC cardholder shall provide the original invoice for the initial purchase of the SVC card, the SVC card, Bonus Value Card and the cardholder’s valid identification documentation. At the time of refund, Bonus Value Cards shall be returned to the Hotel with the original value issued. Refund exceeding RMB 100 shall be made to the cardholder’s bank account. Refund of RMB 100 or below may be paid in cash.
10.3
Members can recharge credits value at RMB 2,000, 3,000, 4,000 or 5,000 in the SVC Cards in the Hotels, provided the balance of each SVC card shall not exceed RMB 5,000 after the recharge.
10.4
SVC Card holders with memberships may upgrade membership in accordance with the rules on membership in clause 8 of this Terms and Conditions.
10.5
Official invoice will only be issued upon the initial purchase of the SVC Cards or recharge of the SVC Cards. No official invoice will be issued by the participating outlets on the subsequent visits.
10.6
No interest shall accrue on the stored value credits.
10.7
Unless agreed otherwise by the Hotel, SVC Cards may not be used to settle room payments. In no case, any payment at the Front Desk with SVC Cards shall constitute purchasing Qualifying Goods and/or Services under clause 4 and clause 8.
11.
Gift Card
11.1
Amount of each Gift Card shall be at RMB 500 or RMB 1,000.
Individual Purchase:
For one time purchase of Gift Cards in the amount of RMB 10,000 or above, purchasers shall provide their valid identification documentation and contact details in purchasing the Gift Cards. For one time purchase of the Gift Cards in the amount of RMB 50,000 or above, payment must be made via bank transfer.
Entity Purchase:
For one time purchase of Gift Cards in the amount of RMB 10,000 or above, purchasers shall provide their valid identification documentation and contact details in purchasing the Gift Cards. For one time purchase of the Gift Cards in the amount of RMB 5,000 or above, payment must be made via bank transfer.
11.2
Credits stored in the Gift Cards are valid for 36 months from date of issuance of the Gift Cards. Upon request within 6 months from the end of the validity period, Gift Cards can be activated and extended for 12 months (“Extension Period”). If the Hotel does not receive the request for activating the Gift Cards within such 6 months, all remaining credits shall be deemed void upon the expiration of such 6 months. All remaining credits not used in the Extension Period shall be deemed void upon the expiration of the Extension period.
11.3
Gift Cards are not rechargeable.
11.4
Official invoice will only be issued upon the initial purchase of Gift cards. No official invoice will be issued by the participating outlets on the subsequent consumption.
11.5
Gift Cards are transferable, but are not replaceable for card loss.
11.6
Credits stored in the Gift Cards are refundable, provided the Gift cardholder shall provide the original invoice, the Gift Cards and the cardholder’s valid identification documentation. Refund exceeding RMB 100 shall be made to the cardholder’s bank account. Refund of RMB 100 or below may be paid in cash.
11.7
Unless agreed otherwise by the Hotel, Gift Cards may not be used to settle room payments.
12.
Bonus Value Card
12.1
Credits stored in the Bonus Value cards are non-refundable and is valid for 12 months from date of card issued. Credits which are not used by the end of the validity period will be forfeited without further notice to the guests and without any liability whatsoever on the part of the Hotel in respect thereof.
12.2
Bonus Value Cards are not rechargeable.
12.3
Bonus Value Cards are transferable, but are not replaceable for card loss.
12.4
Bonus Value Card may not be used for any payment at the Front Desk.
13.
Lost or stolen cards
13.1
In the event that a Membership Card or SVC Card is lost or stolen, the cardholder must immediately report to the Hotel Food & Beverage Loyalty Office. Hotel will freeze any credits in the card within a 24 hour period from notification, and will not be held responsible for any credits redeemed following the loss of the card and Member accepts it’s their sole responsibility to ensure the safe keeping of their Membership Card, SVC Card, Gift Cards and/or Bonus Value Cards at all times.
13.2
Replacement of Membership Cards and SVC Cards will only be issued upon provision of identification documentation. If card holder is unable to provide valid identification documentation or card is not attached to card holder’s profile, no replacement card will be issued and any credits held within the account will be frozen. If the freezing period exceeds 2 years from the freezing date, all remaining credits in the card will be deemed void.
13.3
RMB 50 administration fee will be applicable for card replacement.
13.4
In the event of a Gift Card or Bonus Value Card is being lost or stolen, no replacement card will be issued and any credits within the card will be deemed as void.
14.
Miscellaneous
14.1
These Terms and Conditions shall be governed by the laws of People’s Republic of China.
14.2
These Terms and Conditions are written in Chinese and English. Each version shall have same legal effect.
14.3
All disputes, controversies or claims arising out of or in connection with this Terms and Conditions shall first be discussed by Member and Hotel with the objective of resolving such dispute, controversy or claim in a friendly manner. If such efforts fail to bring a resolution, such disputes, controversies or claims shall be finally settled by arbitration of China International Economic and Trade Arbitration Commission Shanghai Sub-Commission ("CIETAC ") under its Arbitration Rules for the time being in force. The decision and award of the arbitrator shall be final and binding and shall be enforceable in any court of competent jurisdiction in accordance with any applicable national law.
